Judicial and administrative processes constitute the fundamental legal instruments, powerful weapons that jurists need – and must – master widely to do justice to those under their jurisdiction, in any quadrant of material or extra-patrimonial rights of modern civilization. In this scenario of profound transformations – whose beginning is came with the CF/1988, which engendered the genesis of the collective guardianship microsystem (CDC/1990), and soon after the Civil Code of 2002 – we had, with the CPC/2015 and Law 13,467/2017, new and profound adjustments principles and instrumentals, which we delve into in depth in this new edition. Among these changes, we can mention: Provisional Measure 905/2019, which caused structural changes in the Collective Labor Process (limitation and interference in the autonomy and independence of MPT members, in Law 7,347/1985, in the Conduct Adjustment Term (TAC), in the civil investigation, and in the allocation of fines or compensation for collective moral damage and for non-compliance with TAC to a new federal fund);Economic Freedom Law - Law 13,874/ 2019 –, which also caused substantial changes (exclusivity of labor inspectors in labor inspection, among countless others); New extrajudicial title to be executed in the labor court — the term of commitment, from the Ministry of Economy, resulting from the new wording of the arts. 627-A and 628 of the CLT; New rules on intercurrent prescription; New forms of attachment and judicial guarantee insurance in the Labor Court; New doctrinal and jurisprudential developments on labor default fees. We believe that, in this way, we offer the legal community in this 4th edition, what it certainly deserves and needs: the study and development of all the most recent changes implemented in the individual, collective and procedural legislation of Labor Law, in an unprecedented, updated and original way. ?
