The 1st edition of Pure Theory of Law, originally published in German in 1934, constitutes one of the most important works of Legal Theory of the 20th century. In it, Kelsen summarizes some ideas developed since the beginning of his professional career. The work defends a pure science of law, that is, separated from both sociological and political influences. It is part of a phase of Kelsen's theory strongly influenced by neo-Kantianism, which is perceived by its constructivist conception of science, that is, by the idea that the way in which the subject knows constituted the object studied, by the characterization of the duty to be as a transcendental category in the sense of Kantian philosophy, and also by considering the fundamental norm as a transcendental logical condition of the method of knowledge of positive law, also in the sense of Kantian philosophy.?
