Book, Consumer Law (Khouri) 7/21[LS]
Descrição
This book was prepared based on rich jurisprudential and bibliographical research, including support from foreign doctrine. Very didactic, its language is easy to assimilate, without, however, neglecting the depth that the topics require from legal operators, from students, lawyers, prosecutors and judges. It presents a systematized knowledge about Consumer Law and emphasizes the importance of Consumer Protection Code in the Brazilian legislative system based on a historical description of the constant evolution of the concept of contract. Its approach ranges from Roman times to the present, in which the new social and economic reality determined the emergence of a contract with a different profile than that in force at the time the Civil Code of Clóvis Beviláqua was drawn up. The text explains this difference and shows the social importance of a business relationship in which the principle of equality, enshrined in the Constitution, and the equivalence of benefits, the foundation of any fair bilateral relationship, are preserved. The work highlights the main institutes enshrined in the Code of Consumer Protection, such as objective good faith, enormous damage, resolution due to supervening fact and disregard of the legal entity. It analyzes three topics that are the most difficult in the field: nullities in the CDC, responsibility for the fact of the product or service and, finally, consumer defense in court. The reader will find, in this edition, important aspects related to Law 13,709/ 2018, General Personal Data Protection Law, recently in force, in addition to the impacts caused by the coronavirus pandemic, analyzed by the author. Recommended work for the legal operator who deals with the Consumer Protection Code when carrying out any action involving consumer rights, discussion of banking contracts and minimum elements of dogmatics relevant to the area. Textbook for the Consumer Law discipline and complementary reading for the Civil Liability, Contracts and Collective Proceedings disciplines of the undergraduate Law course.?
